We're seeking community feedback, via submissions, on a proposed Road Discontinuance in Murray Street, Rutherglen.
Council intends to discontinue a section of road abutting 27 Murray Street, Rutherglen and the land transferred to the adjoining landowner.
Council gives public notice under Section 114 of the Local Government Act 2020, of its intention to discontinue a section of road reserve abutting 27 Murray Street, Rutherglen (the Subject Land), and to transfer the subject land to the owner of 27 Murray Street, Rutherglen at a nominal cost once its road status has been discontinued.
Background
In May 2024, the owner of 27 Murray Street requested that Council support the removal of road status for the land abutting their property as it has been fenced and incorporated into their land for over 30 years and is not listed on Council’s Register of Public Roads.
The Subject Land is a longstanding encroachment within the adjoining property and is not required for road purposes. A valuation of the land has been obtained in accordance with statutory requirements. Support from service authorities has been obtained in accordance with statutory requirements.
